Sections 146, 148, 152, 154 and 193 of the Act to ensure the responsible governance of energy resources and to amend various legislative provisions (2025, chapter 24); Sections 67.1, 87 and 100 of the Petroleum Products Act (CQLR, c.R-6.01); Sections 23.1 and 23.2 of the Petroleum Products Regulation (chapter P-30.01, r. 2).
The Act to ensure the responsible governance of energy resources and to amend various legislative provisions (2025, chapter 24), assented to on June 7, 2025, amended the Petroleum Products Act (PPA) and the Petroleum Products Regulation (PPR), among others.
Whereas, in accordance with section 193 of the Act to ensure the responsible governance of energy resources and to amend various legislative provisions, its amendments to the PPA and the PPR will come into force on April 1, 2026, the Régie de l’énergie (the Régie) is currently developing a secure portal for merchants selling gasoline or diesel fuel in Québec to enter in real time the sale prices of these products at each of their establishments, which prices will then be posted, also in real time, on a website that the Régie will make available to consumers.
Section 23.1 of the PPR specifies the categories of gasoline and diesel fuel for which prices must be made accessible.
As stipulated in section 67.1 of the PPA, merchants are exempt from the requirement to post their prices for gasoline or diesel fuel at establishments with gasoline or diesel fuel sales below 500,000 litres per year or situated north of the 55th parallel. Under section 23.2 of the PPR, the following are also exempt from this requirement :
1. a marina;
2. an outfitting operation;
3. a snowmobile stop;
4. a cardlock facility where trucks on major highways fill up;
5. a wholesale facility with an external reservoir.
General information and details about the portals will be made public, as soon as they are available, on the Régie’s website at www.regie-energie.qc.ca. The Régie will also conduct consultations in October 2025 with the stakeholders affected by these new legal provisions.
As of April 1, 2026, the chairman of the Régie will have powers of inspection and investigation to ascertain compliance with section 67.1 of the PPA (section 87 of the PPA). Furthermore, any merchant who contravenes the requirement to post their sale prices for these products is liable to a fine of $1,000 to $2,000 in the case of a natural person and $2,000 to $4,000 in all other cases (section 100 of the PPA).
