RÉGIE DE L’ÉNERGIE
Declaration by fuel distributors for the purpose of calculating the annual share payable to the Minister of Sustainable Development, Environment and Parks
Sections 85.40, 85.41 and 85.44 of the Act respecting the Régie de l’énergie (CQLR, c.R-6.01);
Regulation respecting the annual contribution payable to the Minister of Sustainable Development, Environment and Parks under section 10.5 of the Act respecting the Ministère du Développement durable, de l’Environnement et des Parcs (RLRQ, c.6.01, r. 5.1);
Sections 10.2 and 10.5 of the Act respecting the Ministère du Développement durable, de l’Environnement et des Parcs (RLRQ, c. M-30.001);
Section 14.2 of the Act respecting the Ministère de l’Économie, de l’Innovation et de l’Énergie (CQLR c M-14).
Section 85.44 of the Act respecting the Régie de l’énergie (the Act)provides that every fuel distributor (gasoline, diesel fuel, heating oil, propane) must file a statement with the Régie de l’énergie (The Régie). By virtue of Sections 10.2 and 10.5 of the Act respecting the Ministère du Développement durable, de l’Environnement et des Parcs, this requirement is applicable, with certain exceptions, to any fuel distributor who:
1. Refines, manufactures, mixes, prepares, or distills fuel in Québec;
2. Brings fuel or causes fuel to be brought into Québec in one or more receptacles with a total capacity of over 200 litres, except fuel contained in a fuel tank installed as standard equipment to supply the engine of a vehicle;
3. Exchanges fuel, in Québec, with a person described in the first paragraph;
4. Is a legal person or partnership that brings fuel into Québec for a purpose other than resale.
The Régie must establish the annual contribution payable by an energy distributor in conformity with Section 85.41 of the Act, using the completed volumes statements received, considering directions, objectives and targets of the integrated energy resource management plan referred to in section 14.2 of the Act respecting the Ministère de l’Économie, de l’Innovation et de l’Énergie. Until the Government approves that first plan, the policy directions to be complied with and the objectives and targets to be achieved regarding energy and energy efficiency referred to in that section 14.2 are those established by Order in Council 537-2017 (2017, G.O. 2, 2884, French only), with the necessary modifications.
Statement forms
Any person who meets the definition of “fuel distributor” set out in the Act respecting the Ministère du Développement durable, de l’Environnement et des Parcs must file the required statementwith the Régie by March 31, 2026.
